How is automated decision-making defined according to data protection laws?
Automated decision-making under data protection law is defined as decisions based solely on automated processing, including profiling, which produces legal effects concerning the data subject or similarly significantly affects them. This is in accordance with Art. 22 of Act No. 90/2018 on Data Protection and the Processing of Personal Data, which reflects Art. 22 of Regulation (EU) 2016/679, the General Data Protection Regulation.
Act No. 90/2018 ensures data subjects the right not to be subject to a decision based solely on automated processing unless certain conditions are met, such as if the decision is necessary for entering into, or performance of, a contract, is authorized by law, or is based on the data subject's explicit consent.
It also stipulates that the data controller must implement suitable measures to safeguard the data subject's rights and freedoms and legitimate interests, including at least the right to obtain human intervention, to express their point of view, and to contest the decision.
